Can you fly a drone at the beach?

UPDATED OCTOBER 2026

Often yes, but check three things first: who manages the beach, the airspace above it, and the wildlife on it. City and county beaches are often open to drones under FAA rules. State park beaches vary by state, and national seashores managed by the National Park Service ban drones without a permit. On every beach, stay away from crowds, marine mammals and nesting birds.

Can you fly at the beach?
The beach's manager decides where you can take off. FAA airspace rules and federal wildlife laws apply on every beach.

1. Who manages the beach?

Beach type Typical rule Example
City or county beach Often allowed, but some towns limit times or launch spots Check the town's code
State park beach Depends on the state Florida state parks don't allow takeoff or landing
National seashore or park Banned without a special permit Cape Cod, Canaveral, Gulf Islands, Padre Island
Private or resort beach Owner's permission to launch Hotel and condo frontage
Military or space center nearby Restricted airspace Check the map

State examples: Florida beaches and California beaches.

2. Check the airspace

Many beaches sit close to airports, military bases or space centers. Before you fly:

  1. Open B4UFLY or Aloft at the exact spot.
  2. If it's controlled airspace, request LAANC authorization.
  3. Check for temporary flight restrictions, which are common for air shows, launches and VIP visits along the coast.
  4. Stay at or below 400 ft and keep the drone in sight. Distance over open water is hard to judge.

3. Protect the wildlife

  • Marine mammals. Seals, sea lions, otters, whales and dolphins are protected by the federal Marine Mammal Protection Act. Flying close enough to change their behavior can count as harassment.
  • Nesting birds and sea turtles. Many beaches close nesting areas in spring and summer. Shorebirds may flush and abandon nests when a drone passes over.
  • Marine sanctuaries. Some coastal sanctuaries limit low flights by motorized aircraft over parts of the shore.

If an animal looks up, moves away or changes what it's doing, you're too close. Climb and leave.

4. Watch the people

  • Don't fly over sunbathers, swimmers or crowds. Recreational pilots can't fly over people, and Part 107 pilots need their drone and operation to qualify.
  • Lifeguard and rescue helicopters work beaches. Land right away if one approaches.
  • Early morning is quieter, with better light and fewer people.

Beach flying tips

  • Take off from a landing pad. Props kick sand into motors and the gimbal.
  • Watch the wind. Coastal wind is stronger and gustier than inland. Fly upwind first.
  • Fly high enough. DJI warns vision sensors may not work properly over water, so don't rely on them to hold height over waves.
  • Set Return to Home altitude above nearby cliffs, buildings and masts, and set Signal Lost to RTH.
  • Turn back at 50% when the wind is behind you on the way out.
  • Shoot with ND filters on bright days to keep motion smooth.
  • Clean it after. Wipe salt off with a slightly damp cloth, never rinse the drone, and let it dry.

Common mistakes

  • Assuming a beach is a "public place" where anything goes
  • Launching from inside a state park or national seashore boundary
  • Chasing dolphins or hovering over seals for a closer shot
  • Low passes over the surf, where most beach crashes happen
  • Flying in salt spray or fog. Consumer DJI drones aren't water resistant.

Quick answers

Can I fly a drone on a public beach? Often, if the managing city or county allows it and the airspace is clear.

Do I need a permit for beach photos? Not usually for fun. Paid shoots need Part 107, and some towns require a filming permit.

What if my drone lands in the water? Get it out, remove the battery and don't power it on. See drone fell in water.
