Can you fly a drone at Niagara Falls?

UPDATED OCTOBER 2026

No, not as a tourist or hobbyist. The airspace over Niagara Falls is restricted on both sides of the border. Niagara Falls State Park in New York bans drones and says no permit will be issued, and the Canadian side is a Transport Canada restricted area where you need special approval plus a Niagara Parks permit.

Drone rules at Niagara Falls
Both sides of Niagara Falls sit inside restricted airspace. New York's state park bans drones outright, and the Canadian side needs Transport Canada and Niagara Parks approval.

The US side: Niagara Falls State Park

The falls on the New York side are inside Niagara Falls State Park. The park's own rules point to a federal flight restriction in 14 CFR Part 93, Subpart E ("Flight Restrictions in the Vicinity of Niagara Falls, New York"). Under it, flights below 3,500 feet are restricted, so the park treats the area as a no-fly zone for drones. The park states that drones are prohibited and that it will not issue a permit, even to film crews or Part 107 pilots.

That covers launching from Goat Island, Prospect Point, the observation tower area and the rest of the park. Flying in from outside the park doesn't help, because the flight restriction is about the airspace, not just the land.

The Canadian side: restricted airspace

On the Ontario side, the airspace over the falls and gorge is restricted area CYR518. According to Niagara Parks, it runs along the Niagara River from about Whirlpool Road in the north to the Welland River in the south, from the ground up to 3,500 feet above sea level. To fly there you need authorization from Transport Canada, and Niagara Parks does not allow drones on its property without a permit. Permits are aimed at commercial filming, not recreational flights.

Visitors from the US should also know that Canada has its own drone rules. Foreign pilots generally need a Special Flight Operations Certificate from Transport Canada to fly a drone of 250 g or more. See our Canada drone laws guide and the official rules at Transport Canada.

Does a sub-250 g drone change anything?

No. A DJI Mini 5 Pro, Mini 4 Pro or Neo skips FAA registration for recreational use, but weight doesn't exempt you from restricted airspace or park rules. The ban applies to every drone.

What you can do instead

  • Fly elsewhere in the region. Outside the restricted areas, normal rules apply. In New York, that means the TRUST certificate, FAA registration for drones of 250 g or more, staying at or below 400 ft, and LAANC near Niagara Falls International and Buffalo airports.
  • Check the map before every flight. Use B4UFLY or Aloft in the US and NAV Drone in Canada. If either shows a restriction, don't launch.

Penalties

Flying in restricted airspace can bring FAA enforcement in the US and fines from Transport Canada. Park police on both sides watch for drones, especially during fireworks and events.
