Rarely over the beach or Boardwalk in summer, because of the crowds. In Ocean City, Maryland, the town's current online code has no drone section, and Maryland law limits local drone rules, but the town still manages its own beach and Boardwalk property and recreational pilots can't fly over people. Ask the town or Beach Patrol before launching there. On the New Jersey shore, Ocean City and Wildwood follow FAA rules and New Jersey's drone law, but the towns control their own beaches and boardwalks, so check local rules before you launch. Everywhere, recreational pilots can't fly over people.

Ocean City, Maryland
-
Town rules: some guides still describe a summer ban on drones over the beach and Boardwalk, but no drone section appears in the current Town of Ocean City code. Ask the town or Beach Patrol for the current policy before you launch from town property.
-
Crowds: from late spring to early fall the beach and Boardwalk are packed. FAA rules bar recreational pilots from flying over people, so summer days are effectively out.
-
Assateague Island National Seashore, just south, is a National Park Service unit. Its laws and policies page says drones may not be launched, landed or operated there. Assateague State Park is run by Maryland DNR; contact the park manager before flying.
-
Airspace: Ocean City Municipal Airport is on the mainland side, and Salisbury has controlled airspace. Check B4UFLY or Aloft.
Maryland law preempts county and city drone flight rules, but towns can still manage takeoff and landing on property they own. See Maryland drone laws.
Ocean City and Wildwood, New Jersey
- Beaches and boardwalks belong to the towns. New Jersey's drone law overrides conflicting local ordinances, but towns can still manage their own land. Ask the city or beach patrol before launching from the sand or boardwalk.
- New Jersey's drone law (N.J.S.A. 2C:40-28) makes it an offense to endanger people or property, fly under the influence or interfere with first responders. Flying over a packed beach could fit the first.
- Airspace: Atlantic City International has controlled airspace north of Ocean City, and Cape May County Airport is near Wildwood. Coast Guard Training Center Cape May is nearby. Check every spot.
- State parks like Cape May Point and Corson's Inlet ban drones without state approval.
- Cape May National Wildlife Refuge is federal land; don't fly there without refuge permission.
Crowds, events and wildlife
- Summer weekends, fireworks, air shows and boardwalk events bring crowds and sometimes TFRs. See drones near fireworks.
- Piping plovers and least terns nest on parts of both coasts behind posted fencing.
- Dolphins pass close to shore. Keep your distance.
Where and when to fly
Early mornings outside the summer season are the easiest time on both shores. Back-bay marshes and private property with permission are often better launch spots than the main beach. Wind off the ocean is strong, so keep a healthy battery reserve.
Before you fly
- Pass the TRUST test and register drones of 250 g or more.
- Check the town's beach rules and season dates.
- Check airspace and TFRs.
- Stay at or below 400 ft, in sight, and not over people.
The 249 g DJI Mini 5 Pro needs no recreational registration and handles coastal wind well. The DJI Neo suits calm mornings at your rental. More in can you fly a drone at the beach.
Rules current as of October 2026. This is general information, not legal advice.
