Yes. The DJI Air 3S is legal to buy, own and fly in the United States. In December 2025 the FCC added foreign-made drones, including DJI, to its Covered List, which stops new models from getting FCC authorization. The Air 3S was authorized before that, so it stays legal and keeps receiving updates. Unlike the Mini 5 Pro and Mavic 4 Pro, the Air 3S was launched and sold in the US by DJI. We sell it from $1,209.
What the FCC decision means for the Air 3S
- Buying: legal from US retailers, including authorized dealers like us.
- Flying: legal under normal FAA rules. Register it, broadcast Remote ID (built in), and follow recreational or Part 107 rules.
- Updates: in May 2026 the FCC extended firmware and software updates for already-authorized drones to January 1, 2029. DJI released Air 3S firmware as recently as July 30, 2026.
- New models: future DJI drones that need new FCC authorization can't get it while the Covered List decision stands.
- Tariffs: imported drones have carried a Section 232 tariff since September 3, 2026, which affects prices.

Is the US version different?
US units ship with FCC-compliant radios. DJI rates the Air 3S video link at 20 km under FCC rules, the figure that applies here. US rules still require visual line of sight, so that range mainly means a steadier signal.
What you need before flying in the US
- FAA registration: $5, valid 3 years. The Air 3S weighs 724 g, over the 250 g line. Mark the number on the outside of the drone. See FAA registration.
- Remote ID: built in. Add the serial number to your registration.
- TRUST certificate for recreational flying, or a Part 107 certificate for any business use. See Air 3S license.
- Airspace check with B4UFLY or Aloft before each flight, and LAANC authorization in controlled airspace.
Traveling with it
Air 3S batteries are 62.5 Wh, under the 100 Wh airline threshold, so you can carry spares in your carry-on without airline approval. Spare lithium batteries never go in checked bags. See traveling with a drone.
